Felony (Definition):
Felony means an offense for which a sentence to a term of imprisonment in the custody of
the state department of corrections is authorized which is potentially punishable with
one year or more in prison. These offenses usually include crimes involving a serious
physical injury or death, crimes involving property loss of $250.00 or more, certain
DUIs and assortments of other crimes which could be felonies.
Misdemeanor (Definition):
A misdemeanor is any crime which has a maximum punishment
of up to six (6) months in the county jail, a fine up to $2500.00 plus additional
surcharges. These types of cases are in Municipal Court or Justice Courts which have
been cited by police officer, usually include most traffic offenses, like DUIs, Domestic
Violence offenses, Shoplifting offenses, and other minor crimes. In almost all cases, a
defense attorney can appear on behalf of a Defendant throughout the Pretrial phases
which allows you from having to take time off work to appear in Court. However, there
are a few Judges who require a Defendant's presence at each and every court date.
