Jury Trial:
In felony cases, a "Jury Trial" is comprised of jurors from the community who will
determine whether you are "not guilty," "guilty," or whether they are "hung" and
cannot render a unanimous verdict. If the jury is "hung," the prosecutor can move
to dismiss the charges, offer a new plea agreement, or they can retry the case on
the exact same charges that were hung on.
Bench Trial:
You also can do what is known as a "Bench Trial," which is a trial directly to the
judge. Normally, on felony cases you do not want to do this, unless your case has
specific facts or legal issues which make this more appropriate as most judges have
been around for a period of time where almost nothing will anger them or inflame
their passions.
