Motion to Modify Sentence or Probation can be filed at any time after the original
sentencing has been imposed by the Courts. Ariz.R.Crim.P., Rule 24.3. This request can
be for financial hardship on you to ask the Court to allow your probation fee or
restitution fee to be reduced to an affordable amount or modified the amount as it has
been paid by an insurance company and the record needs to reflect this. Additionally,
it can be to request that deferral jail be deleted or again deferred to continue to prove
yourself.
These requests can be done by first contacting the Probation Officer to open up a
dialogue and develop a rapport and see about them being on your side. Additionally,
we include letters from family, friends and employers detailing all of the positive
efforts made since being on probation and explain how certain terms would only be
detrimental to rehabilitation and why they should be removed. This is done in order
to allow the Court to perceive you as a person and not just as a number.
