Arizona does provide for what is known as a "Judgment of Guilt Set Aside" pursuant to
A.R.S. §13-907 and "Restoration of Civil Rights" pursuant to A.R.S. §13-912. After a motion
is filed and if the Court grants the Motion to Set Aside Judgment of Guilt, then a person
can tell people that he has not previously been "convicted" of a crime for certain crimes.
In felony matters involving a conviction we can file a motion to request for
"Restoration of Civil Rights." This is an attempt to allow you to vote and for
the restoration of the right to own a firearm. However, certain types of convictions
may not allow a person to file for a Judgment of Guilt Set Aside for penalties
imposed by §28-3304, §28-3306, §28-3307, and §28-3308. For a
more definitive finding of whether your case allows you to set aside the judgment of
guilt, contact an attorney.
