Formal Arrest:
An arrest can occur whenever an officer has placed you in custody which is usually
when you have actually been handcuffed and taken to another location like a police
station.
Cited and Released:
This is generally when an officer writes you a citation or commonly called a
"Ticket" for an alleged offense and then has you sign the bottom promising to appear
in court on a certain date for what is called an "Initial Appearance."
Booked:
"Booked" means you were taken to the jail in order to be fingerprinted and
photographed. Generally you are held until you are released by seeing a judge who
sets conditions such as "Own Recognizance Release," "Third Party Release," "Pretrial
Services Release," and/or by "Bond" which sometimes can be accomplished by the
officer telling you your bond amount according to a "Bond Schedule."
Complaint:
Is a document the prosecutor prepares called a "Long Form Complaint," which is a
written statement of the facts that allegedly constitute an offense. The Complaint
is a sworn statement submitted to a judge who then may issue a "Summons" by either
personal service or sent by certified mail and if you have moved, the summons will
be returned to the court and a "Warrant" will be issued for your arrest.
Indictment:
After a "Grand Jury" has met and, an "Indictment" can occur after hearing testimony
presented by a prosecutor and they then decide whether probable cause exists for a
crime to issue a "True Bill" which is then served personal service or sent by certified
mail and if you have moved, the summons will be returned to the court and a "Warrant"
will be issued for your arrest.
